retaining attorneyThis is the next article in my series on the handling of workers’ compensation cases in Peoria and other Illinois areas. My last article discussed the process of filing a workers’ compensation claim in our state. It is important to make sure that you report the injury to your employer, and seek medical care, as soon as possible. Waiting to report the situation can result in the employer attempting to claim that the injury was not work-related. In this article I will be discussing the importance of retaining an attorney to assist you with your case. If you are in need of assistance then contact my office today to speak with a lawyer.

While an attorney is not required for one to bring a workers’ comp claim, having counsel is suggested as a number of disputes can arise. The first of these disputes is whether the injury is work-related. Situations which can result in a dispute over the source of the injury include matters where the employer did not immediately report the injury. They can also include situations where it is not readily apparent that the injury is tied to some aspect of the employee’s job. An example of this could be someone who suffers a back injury even though their job is “non-physical” in nature. Finally, the employer may attempt to claim that the injury was due to a pre-existing condition. In each of these situations, counsel will be familiar with what evidence to present, and how to present it, when making an argument that the injury was work-related.

A second reason to retain an attorney is the level of dispute which can arise over the extent of the victim’s injuries. The treating physician’s records and opinions will be considered. If the employer disagrees with those opinions, however, then they may request an Independent Medical Examination (IME). If the IME varies from the treating physician’s views, as to the extent of the injuries, then an attorney will have the experience necessary to question the Independent Medical Examiner’s process. Counsel will also be familiar with what types of arguments an arbitrator may, and may not, be receptive to. Moreover, counsel will be familiar with the handling of the proceedings and this will help to ensure that the arbitrator is able to consider all aspects of one’s injuries.

Finally, one of the key benefits of having an attorney is that counsel can help you be aware of what you should expect as the process moves forward. There are several steps which go into the handling of a claim and, in a matter where the employee is seriously injured, it can take multiple years to resolve a case. The mishandling of key aspects could result in one not receiving the level of benefits to which they are entitled. Counsel will make sure that one knows what to expect and will be available to answer their questions throughout the process. This helps to prevent one from hurting their own case.
