Premises liability law bookThis article is being written to begin a series on situations in which Peoria, Illinois landlords may be liable for injuries sustained by tenants or visiting guests. I feel it is important to write on this topic as many individuals are unsure of what rights they have when they are injured inside of a rental property or while inside of a common area. Failing to name all the possible parties in a lawsuit can result in a victim not receiving the full amount to which they are entitled. I am writing this series, therefore, with the goal of providing information which will help people to better understand their situation. It is also my goal to provide information which will assist with the selection of an attorney. If you or a loved one are in need of assistance then contact my office today to speak with a lawyer.

I will be addressing several topics over my coming articles. Issues which I will be analyzing include:

  • Landlord liability for a dog bite
  • Landlord liability for auto accidents which occur on their property (such as in an apartment complex parking lot)
  • Injuries caused by hazardous conditions inside of a dwelling
  • Dealing with a landlord’s insurance carriers

I have chosen to address these particular topics for multiple reasons. First, while a dog owner faces strict liability for a dog bite, a landlord may also face liability if their own negligence created a dangerous situation involving the animal. Second, if the failure to properly mark, light, or otherwise maintain a parking area led to an accident, then the landlord may be liable for a victim’s injuries. Third, numerous dangerous conditions inside of a premises can result in harm to a tenant or guest. If the landlord failed to properly maintain the property, and an injury resulted, then the victim may have a case. Finally, dealing with an insurance carrier can be highly complicated and it must be remembered that the carrier does not represent the interests of an injured individual. An experienced attorney can help with the process.
